These Terms of Service ("Terms") govern your use of ASMR Studio (the "Software"), a personal desktop application operated by Antonio ("we", "us"). By installing or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. What the Software does

ASMR Studio is a single-operator desktop tool used to generate ASMR videos and publish them to the operator's own connected social accounts, including TikTok via the TikTok Content Posting API. It is not a public service, marketplace, or multi-user platform, and is not offered to or used by third parties.

2. Your account and responsibilities

• You are responsible for the TikTok account you connect and for all content you choose to upload through the Software.
• You are responsible for ensuring you hold the necessary rights to any content you publish, and that the content complies with all applicable laws.
• You must keep your API credentials and device secure.

3. TikTok integration and compliance

The Software uses TikTok's official developer APIs to post content to your own account. Your use of TikTok through the Software is also subject to TikTok's own terms and policies, including the TikTok Terms of Service and Content Sharing Guidelines. You agree not to use the Software to violate those policies, to post content you are not authorized to post, or to circumvent any TikTok posting limits or safeguards.

4. Acceptable use

You agree not to use the Software to post unlawful, infringing, deceptive, harmful, or abusive content, to impersonate others, to spam, or to interfere with the operation of any connected platform.

5. Content ownership

You retain ownership of the content you create and publish through the Software. We claim no ownership over your content and do not access, store, or redistribute it beyond what is necessary to perform the upload you request.

6. Disclaimer of warranties

The Software is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that third-party APIs it relies on will remain available.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, content, or account access, arising out of or related to your use of the Software.

8. Changes to these Terms

We may update these Terms from time to time. Continued use of the Software after an update constitutes acceptance of the revised Terms. The "Last updated" date above reflects the latest revision.
